b) Legislation
▪ Legislations refers to the laws that are established by the
Parliaments at federal level and by the State Legislative
Assemblies at the state level.
▪ The Parliament and State Legislatures are not supreme
and so they have to enact laws subject to the provisions
set out in the Federal and State Constitution such as:
(i) Parliament – Acts (Principle, Amendment, Revised
and Consolidated Act)
(ii) State – Enactments
(iii) Sarawak – Ordinances
(iv) During emergency – Ordinances
(v) April 1st, 1946 – sept 10th 1959 – Ordinances
c) Subsidiary legislation
▪ Defines as rules, regulations, by laws, order, notifications,
conditions made under legislations (in details which
legislature has neither time/technical knowledge on it).
▪ Authorized by YDPA to advise him on country’s matter
(Government - PM and cabinet).
▪ Government set up various agencies to ensure the smooth
enforcement of the law.
▪ Three main components, namely ministries,
departments, and statutory bodies.
▪ Any SL which inconsistent with constitutions shall be
void.
