                               ▪  Prime  Minister  responsibilities  is  to  form  a  Cabinet  (a

                                   body  that  carries  out  the  executive  duties  held  by  the

                                   YDPA).

                               ▪  Each  Minister  is  responsible  for  certain  Ministry

                                   portfolio. Formally, Ministers are :-

                                   (i)  Appoint  by  the  YDPA  on  the  advice  of  the  Prime

                                         Minister.

                                   (ii)  Members  of  Cabinet  (either  a  member  of  Dewan

                                         Rakyat or Dewan Negara).

                                   (iii)  Ministers & Dep. Ministers must not be a member of

                                         State Legislative Assembly.


                           c.  Judicial (executes and dispenses justice)



                               The judiciary is a body of judges in a constitutional system.


                               ▪  Judges are given the power to interpret and execute the


                                   law with the authority vested in them. To carry out all the
                                   judicial  functions,  Federal  Constitution  allowed  for


                                   system of courts.

                               ▪  Courts wield great power in the executive and legislative

                                   bodies because they:

                                   (i)  Have the power to interpret the constitution of the

                                         country.

                                   (ii)  Interpret a certain law.

                                   (iii)  Declare a written law of the Federation or of a state

                                   (iv)  Declare the actions of the government to be illegal.

                               ▪  The  courts  also  have  powers  in  the  legislative  and

                                   executive matters.
