6.1.3 PERSONAL DATA PROTECTION ACT 2010
Around November 2013, The Personal Data Protection Act 2010 (PDPA) was enforced
to regulate the processing of personal data in a commercial transaction. PDPA
applicable where the:
a) If the person is incorporated in Malaysia and personal data is processed in
connection with that establishment by that person or any other person
employed or employed by that establishment.
b) Persons who are not incorporated in Malaysia but use facilities in Malaysia to
process personal data (other than for transit purposes in Malaysia).
PDPA is not applicable for:
a) federal and state governments
b) personal data processed outside Malaysia unless intended to be further processed
in Malaysia.
