2.3 Pre-Contract Procedure
2.3.1 Pre-Contract Procedure
❑ Every construction project, from a building to an infrastructure
project, necessitates the use of a contract. The process of
managing contracts that are made as part of the delivery of a
built asset is known as contract management.
❑ Contract management entails the design, analysis, and
implementation of contracts to maximize operational and
financial performance while minimizing risks.
❑ There are three phases in contract management:
i. The pre-contract phase: this is the preparation stage
before the contract is drawn up
ii. The contract execution phase: at this stage, the final
contract documents are prepared for execution
iii. The post-award phase: this phase is concerned with
ensuring compliance with the conditions of the contract.
❑ Pre-contract management refers to the coordination of
activities that take place prior to the start of construction on a
job site. This step comprises preparing an Invitation to Tender
(ITT), which encourages contractors to submit tender for the
project.
❑ When a prospective supplier's tender results in an offer, the
client and the preferred tenderer enter into re-negotiations.
