                          •  Companies must be invited to tender for construction projects
                             based  on  the  following  budgetary  constraints:(Refer:  Garis

                             Panduan  Penilaian  Tender  Bahagian  Perolehan Kerajaan,

                             Kementerian Kewangan Malaysia):

                              i.   Tenders for works worth less than RM30 million must be

                                   issued to bumiputra-owned (100%) companies.
                              ii.   Tender for works estimated to be worth between RM30

                                   million to RM50 million should be invited to:


                                   •  One hundred  percent  (100%)  Bumiputra-owned
                                      companies;  or  local  companies  listed  on  Bursa

                                      Malaysia,     i.e.,   companies      established     and
                                      incorporated  in  Malaysia  by  citizens  provided  that

                                      foreign individuals' shareholding does not exceed thirty

                                      percent  (30%)  and  the  board  of  directors,
                                      management,  and  employees  are  all  owned  by

                                      bumiputra.
                             iii.  Tender for works estimated to be worth more than RM50

                                  million should be invited to:


                                   •  one  hundred  percent  (100%)  Bumiputra  -  owned
                                      companies; or


                                   •  local companies listed on Bursa Malaysia; or

                                   •  a  joint  venture  business  incorporated  in  Malaysia

                                      (whether or not it is listed on the KLSE) with a foreign

                                      equity stake of no more than forty-nine percent (49%)
                                      with the majority of the Board members, management,

                                      and workers being Bumiputra.
