• In general, the most profitable tender for the government to be
recommended to the Tender Board for acceptance is the one
that passed the first and second stages and is the lowest
according to the adjusted tender price rearrangement after
considering the effect of reducing the completion period and
lowering the tender price.
• If the evaluating officer determines that the lowest tender price
is excessively high in comparison to the Department's
Estimate, such findings must be clearly indicated in the Tender
Report, and an appropriate certification with good cause must
be submitted to the Tender Board, so that either:
i. Manage the acceptance of the tender; or
ii. Not accepting any tender and re-inviting tenders.
• After considering the constraints or time constraints for project
implementation, market conditions, the possibility of a coalition
among tenderers, and other factors, the decision to choose
one of the above recommendations shall be based on the
option believed to be most beneficial to the Government.
• In any case, tenderers who do not pass the Capability
Assessment stage are not qualified for certification and cannot
be certified for acceptance, according to the policy that must
be followed by the evaluating officers in line with this
regulation.
